1. The Doctor You Choose
Under Louisiana law, you do have the right to select your own physician. This doctor will generally be considered your primary physician for the injury, and will likely be the doctor you see the most often.
2. The Doctor Selected By Lousiana for a Second Medical Opinion
Louisiana law also allows for the Louisiana workers’ compensation insurance company to select their own doctor, who you must see for an SMO, or “second medical opinion.” This is done to determine if the independent doctor corroborates the injury and what your chosen doctor is recommending as treatment.
3. The Independent Medical Examination Doctor
When you file a workers’ compensation claim, you may also have to see a third doctor who will conduct an independent medical examination. This doctor is selected by the Louisiana Office of Workers’ Compensation — Medical Services Division, but may also be selected by the Workers’ Compensation judge in your case. This is often done when the employee’s chosen doctor and the independent doctor who offered the second medical opinion disagree on the cause of the injury and/or how to treat it.
